Eurosport wins DSPORT brand ownership suit

Eurosport will be the owner of the brand and mark DSPORT. The Colombo High Court has dismissed the claim suit filed by Lax Sportel.

The court, according to a press note by Eurosport, has ruled that Lex Sportel while claiming the ownership of the DSPORT mark for the territory of Sri Lanka has suppressed material facts.

The court while dismissing the application has also imposed costs on the plaintiff.

The interim application was filed by Lex Sportel, Lex Entertainment and RC Venkateish’s interim in the Colombo High Court after the Delhi High Court had restrained the petitioners from using the DSPORT Mark.

The dispute had arisen after the Discovery network had launched its sports platform Eurosport in India and separated from Venkateish’s entity, which jointly operated the DSPORT channel.

“It is abundantly clear that the 1st Plaintiff (Lex Sportel Vision) is a licensee of the Discovery Networks Asia Pacific (1st defendant)and the 1st Plaintiff was bound to abide by the agreement entered between the 1st Plaintiff and the 1st Defendant. The 1st Plaintiff, being a licensee, is not entitled to claim any rights to the DSport channel,” the court has observed.

“The Plaintiffs have failed to establish a prima facie sustainable case against the Defendants,” the court further stated.

The court dismissed the application for an interim injunction with costs.
